Sexual Violence & Sexual Harassment Policy

1. Policy Application
This policy applies to all members of the MNM Maple College community, including but not limited to students, staff, faculty, administrators, contract service providers, contractors, officers, directors, volunteers, and visitors.

2. Scope
This policy addresses complaints of sexual violence or sexual harassment occurring on MNM Maple College campus or at college events, involving members of the college community as defined in paragraph one (Policy Application).

3. Purpose and Intent
All members of the MNM Maple College community have the right to study and work in an environment free from sexual violence and sexual harassment. This policy outlines prohibited behaviors and the investigative procedures for such incidents.

4. Policy Objectives
MNM Maple College is committed to providing an educational environment free from sexual violence and sexual harassment. The college aims to:

• Educate faculty, staff, and students about this policy and how to identify and prevent sexual violence or harassment.
• Treat individuals reporting incidents with dignity and respect.
• Provide appropriate support and accommodations to survivors.
• Promptly investigate and respond to complaints.

5. Definition of Sexual Misconduct
Sexual Violence includes sexual assault, any form of unwanted sexual act without consent, ranging from unwanted touching to penetration, as well as any violence, physical or psychological, carried out through sexual means.

Sexual Harassment encompasses unwelcome sexual comments or conduct, including but not limited to offensive jokes, displaying explicit material, making suggestive remarks, and inappropriate physical contact.

6. Reporting and Responding to Sexual Violence
All members of the MNM Maple College community must take reasonable steps to prevent sexual violence and report incidents promptly. The college will attempt to maintain confidentiality unless there is an imminent risk of harm to an individual.

The complainant has the right to decide whether the complaint will be dealt with by the police and/or the college. However, in certain circumstances, the college may be required to inform the police without consent if the safety of the community is at risk.

7. Investigating Reports of Sexual Violence
A written complaint of alleged sexual violence may be filed with MNM MAPLE College. The college will conduct an investigation, which includes interviewing relevant parties, providing updates, and determining appropriate disciplinary actions.

8. Reporting Sexual Harassment
All members of the college community must take steps to prevent sexual harassment and report incidents immediately. The college will attempt to maintain confidentiality, except when there is an imminent risk of harm.

9. Investigating Reports of Sexual Harassment
Upon receiving a complaint of sexual harassment, MNM MAPLE College will conduct an investigation, which includes gathering information from relevant parties and determining appropriate disciplinary actions.

10. Disciplinary Measures
If it is determined that a member of the college community has engaged in sexual violence or harassment, disciplinary or corrective action will be taken, up to and including termination of employment or expulsion of a student. MNM MAPLE College will also cooperate with legal proceedings.

11. Making False Statements
Knowingly making a false complaint or providing false information about a complaint is a violation of this policy and may result in disciplinary action.

12. Reprisal
Retaliating against a complainant, acting in good faith, is a violation of this policy and may result in disciplinary action.
